Bouldering gym regulation

Sport climbing and bouldering are high-risk sports. To ensure the highest level of safety, it is essential to strictly adhere to these Rules. However, even when all safety measures are followed, bouldering can still involve the risk of injury or health issues. Using the bouldering facilities is at the sole responsibility of the climbers or their guardians.

The CUBE Boulder Gym and MOOD Boulder Gym, which also includes the climbing and play areas intended for children, are operated by CUBE WALLS Sp. z o.o. Sp.k. based in Kraków (“CUBE WALLS”).

PRELIMINARY PROVISIONS:

  1. Persons using the bouldering facility are required to familiarize themselves with these Rules, accept them, and strictly follow the provisions set out herein. Parents/guardians of minors using the bouldering facility must familiarize themselves with these Rules, accept them, and communicate the safety rules specified in these Rules to the minor.
  2. In case of organizing events at the bouldering facility, certain parts of the bouldering facility or individual walls may be closed to the public.
  3. The MOOD Boulder Gym is primarily intended for use by children. There are no age restrictions for using this area, with the exception that the behavior of users should be appropriate for their age, abilities, and skills, and should also take into account that this area is mainly for children’s use.

AGE LIMITATIONS AND SUPERVISION:

  1. Minors over the age of 14 can use the bouldering facility independently, but only with the consent of their parent or legal guardian.
  2. Minors under the age of 14 can only use the bouldering facility with the consent of their parent or legal guardian, and only under the direct supervision of an adult – an instructor, parent, legal guardian, or another adult person providing supervision. Individuals under the age of 14 cannot use the bouldering facility independently.
  3. Minors may also use the bouldering facility with the consent of an adult who is providing supervision during their use, even if the adult is not the parent or legal guardian. This specifically applies when the consent of the parent or legal guardian is not possible at that moment.
  4. Parents or guardians bear full responsibility for the behavior of minors. The use of the bouldering facility by children or minors under 18 with parental/guardian consent is at the risk of the parent/guardian or supervising person.
  5. To supervise a minor, one parent/guardian may enter the bouldering facility. The entry of additional parents/guardians is only allowed with the approval of the bouldering facility staff, depending on the number of people using the facility. The supervising person cannot independently use the bouldering facility unless they have purchased an entrance ticket.
  6. The behavior of users must be appropriate for their age, abilities, and skills. This also applies to the way in which supervision of minors is carried out.
  7. Persons who, due to serious physical or mental disabilities, are dependent or require supervision, can only stay in the bouldering facility under the supervision of an adult – a parent or guardian, regardless of the age of the person being supervised.
  8. The bouldering facility does not provide care for children and minors. Entrusting care to the bouldering facility staff depends on the availability of this service. It requires prior communication with the staff and obtaining explicit approval.
  9. Individual and group classes organized by CUBE WALLS are intended for adults, unless otherwise stated in the offer of these classes. Before registering for any classes, it is important to ensure whether they are available for minors.

GROUP ENTRY RULES:

  1. Organized groups may use the bouldering facility only with prior approval from the staff. Conducting business or training activities within the bouldering facility is allowed only with prior approval from the staff.
  2. For matters not explicitly addressed by different instructions or guidelines from the staff regarding conditions of entry and use of the bouldering facility by organized groups or individuals conducting business or training activities, the provisions of these Rules apply, especially safety rules and age restrictions.
  3. For organized groups whose members are under 18, the presence of a group supervisor is required during their climbing. One supervisor may be responsible for a maximum of 15 people.
  4. The responsibility for the safety of organized group members or participants in activities (in any form) lies with the group supervisor or the person conducting business or training activities.
  5. The group supervisor or activity leader is additionally responsible for conveying the content of the Rules to all group members, either personally or through legal guardians.
  6. For organized groups, if the group supervisor does not have adequate knowledge and experience in bouldering, supervision by an instructor appointed by the bouldering facility is required.

RULES FOR CLASSES ORGANIZED BY CUBE WALLS:

  1. To participate in classes, punctuality is required. For organizational or safety reasons, the instructor may refuse participation to anyone who is late.
  2. Leaving the facility or the activity area before the end of the class should be done after informing the instructor.
  3. Being late may result in missing the class, particularly if a person on the waiting list has taken the spot.
  4. Before starting the class, participants must inform the instructor about any health issues, injuries, pregnancy, or health problems that may limit their ability to perform exercises.
  5. CUBE WALLS is not responsible for negative consequences of exercises performed independently or contrary to the instructions of the instructor.
  6. The instructor may refuse participation in the class to anyone whose health condition may pose a risk to them or other participants. Persons who behave inappropriately, create safety risks, or violate the provisions of these Rules may be removed from the class.
  7. Participants must immediately comply with the instructions of the staff or the instructor.

SAFETY RULES:

  1. Persons climbing for the first time or those who lack knowledge of safety principles should inform the staff before starting their climb.
  2. Persons who behave inappropriately, create safety risks, or violate the provisions of these Rules may be removed from the bouldering facility.
  3. Users of the bouldering facility are required to immediately comply with the instructions of the staff.
  4. Moving equipment within the bouldering facility without staff consent is prohibited.
  5. After using equipment, it must be returned to its designated location.
  6. Climbing shoes or other sports footwear must be worn in the bouldering facility, along with appropriate clothing that does not contain hard elements or items in the pockets.
  7. The following actions are strictly prohibited in the bouldering facility:
    • Remaining in the fall zone or on the mats beneath climbers;
    • Remaining in the exit zone from other attractions, devices, or training equipment;
    • Entering areas or elements excluded from use, especially elements of climbing walls or other devices and attractions;
    • Leaving any items on the mats in the fall zone;
    • Independently unscrewing or turning grips;
    • Climbing while wearing jewelry on hands, watches, or other clothing items that may pose a danger to the climber or others;
    • Climbing with inappropriate footwear or without footwear, in unsuitable clothing, or with hard elements or objects in pockets;
    • Climbing under the influence of alcohol or drugs;
    • Smoking, drinking alcohol, bringing weapons, sharp tools, or dangerous objects into the facility.
  8. Any technical irregularities, defects, or loose grips should be immediately reported to the staff.
  9. Pets are allowed in the facility, provided that the staff is informed and the pet is properly secured (e.g., on a leash or with a muzzle). Pets are prohibited in the fall zone or on the mats.
  10. In the interest of health and comfort, persons showing visible symptoms of cold or similar illnesses may be refused entry or asked to leave the bouldering facility.
  11. Persons with skin diseases are required to use their own mats or equipment or appropriate footwear.

RISK AND RESPONSIBILITY:

  1. Users of the bouldering facility are required to secure their personal belongings appropriately. The operator of the bouldering facility is not responsible for losses resulting from negligence on the part of users, including for items left or lost in the facility, changing rooms, or waiting areas. Valuable items or items that could be damaged (e.g., phones, cameras) should be properly secured or left outside the facility. Lost items should be handed over to the reception. Found items will be returned after identification by the owner within three weeks from the date they were left.
  2. Each person uses the bouldering facility at their own risk and responsibility, taking into account their abilities, skills, and health condition. Parents, guardians, or supervisors are responsible for the safety of minors. They are also fully responsible for any damage caused by minors.
  3. The person using the bouldering facility or the parents, legal guardians, or supervisors of minors accept that CUBE WALLS is not responsible for damages (including bodily injuries) resulting from non-compliance with these Rules or safety guidelines, or any other damages resulting from using the bouldering facility. These individuals also waive any claims against CUBE WALLS or other entities related to damages incurred during the use of the bouldering facility.
  4. CUBE WALLS is not responsible for accidents resulting from non-compliance with these Rules or improper use of the bouldering facility.
  5. Climbers understand and accept that ultimately their individual actions and interactions determine their own safety and the safety of others. Understanding and respecting safety rules is fundamental to the safety, health, and lives of those present in the bouldering facility.
  6. In case of any accidents, random events, noticing improper behavior of users or their guardians, or observing any defects in the bouldering facility, the staff should be immediately informed.
  7. For security purposes, the operator of the bouldering facility reserves the right to use video surveillance.

PERSONAL DATA AND IMAGE:

  1. The data controller is CUBE WALLS. The full privacy notice regarding personal data protection is available at the reception of the bouldering facility.
  2. Users of the bouldering facility or parents, legal guardians, or supervisors of minors express their consent to the free use and dissemination of images of persons using the bouldering facility, recorded during their visit, for promotional purposes related to the bouldering facility and the activities of CUBE WALLS. This consent applies only to the posting of images on the MOOD, CUBE, and CUBE WALLS websites and their social media profiles. The consent is granted indefinitely and without territorial limitations. At the same time, the aforementioned individuals consent to the processing of their personal data by CUBE WALLS in the context of using their image as described above.
