Regulations for Booking and Purchasing Physiotherapy Services
I. General Provisions

1. These Regulations define the terms for booking and purchasing physiotherapy services provided by the physiotherapist specified in the announcement.
2. Booking and purchasing physiotherapy services provided by the specified physiotherapist are facilitated by CUBE WALLS sp. z o.o. sp. k. located in Kraków, ul. Centralna 41a, 31-586 Kraków, registered in the National Court Register kept by the District Court for Kraków – Śródmieście, 11th Commercial Division, under KRS number 0000791876, NIP: 6751707708, REGON: 383720938 (“CUBE WALLS”).
3. The service booking and the subsequent contract for providing physiotherapy services are concluded between the Client and CUBE WALLS, while the physiotherapy services are independently provided to the client by the Physiotherapist conducting a medical practice as an individual physiotherapy business.

II. Rules for Booking and Purchasing Physiotherapy Services

1. Information about services published on the Booksy portal constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code for using physiotherapy services.
2. Through the Booksy portal, it is only possible to make a booking of the service.
3. Due to the nature of physiotherapy services, which are health services, the provision of such services may depend on various factors for the client’s benefit. The contract for the service is concluded at the place of its provision, directly before the service is performed.

II. Rules for Booking and Purchasing Physiotherapy Services

1. Decisions regarding the choice of diagnostic methods, treatment approaches, and medical techniques are made by the physiotherapist, in consultation with the client, following professional standards, medical knowledge, and ethical guidelines.
2. The provision of physiotherapy services may depend on the Client granting the physiotherapist necessary consents, declarations, and information.

1. Physiotherapy services are provided by a chosen physiotherapist conducting a medical practice as an individual physiotherapy business, separate from CUBE WALLS. Consequently, the physiotherapist is solely responsible for any improper delivery of health services.
2. The physiotherapist holds civil liability insurance for damages arising from non-performance or improper performance of health services, compliant with the Regulation of the Minister of Finance of April 29, 2019, on mandatory civil liability insurance for medical service providers.
3. CUBE WALLS’ role and responsibility are limited to enabling clients to book and subsequently purchase services provided by the physiotherapist.
4. Complaints regarding medical issues and the rules for providing physiotherapy services should be directed to the physiotherapist conducting the medical practice. The physiotherapist’s contact details for this purpose can be obtained before or during the visit.
5. Non-medical complaints (e.g., related to advertisements, booking or canceling appointments, payments) can be submitted to CUBE WALLS via email: info@climbin.eu.
6. To ensure efficient processing, it is suggested that every complaint include the following: the complainant’s details (name, mailing or email address for the response), a description of the subject of the complaint and the circumstances of its submission (date, place), the content of the complaint, and the date.
7. Responses to non-medical complaints are provided within 30 days of receiving the complaint. If resolving the issues raised in the complaint is not possible within this timeframe, a response will include the current position of the entity handling the complaint and may request an extension for addressing the complaint.

What personal data is processed, for what purposes, and on what legal basis?
During the visit booking process, the administrators process only basic personal data, such as name, phone number, and email address.
If additional personal data is required (e.g., for payment processing by CUBE WALLS or health-related data by the physiotherapist), further information about data processing will be provided.
Purpose: Contact with clients and establishing cooperation
Your data may be processed for:

  • Responding to your inquiries, based on your consent (Article 6(1)(a) GDPR).
  • Taking actions upon your request prior to concluding a contract (Article 6(1)(b) GDPR).
  • Pursuing legitimate interests of the Data Controller, such as defending against claims (Article 6(1)(f) GDPR).

Is providing your personal data mandatory?
Providing data is voluntary but necessary for the purposes for which they are processed.
How long will your personal data be processed?
The duration depends on the legal basis:

  • Data processed for contract performance: up to 3 months after the expiration of claims.
  • Data for tax and accounting purposes: as required by law.
  • Data processed based on consent: until consent is withdrawn.
  • Data based on legitimate interests: until an objection is raised.

Who can access your personal data?
Personal data is shared by CUBE WALLS with the respective physiotherapist for booking purposes.
Data may also be shared with public authorities as required by law.
Personal data will not be transferred to third countries or international organizations.

No decisions based on automated processing, including profiling, will be made using your data.
Is your personal data processed securely?
The Data Controller ensures compliance with data protection regulations and safeguards personal data against unauthorized access. IT systems are secured with technical and organizational measures to protect data from loss or unauthorized dissemination.
What rights do you have?
You have the right to:

  • Access and obtain a copy of your data.
  • Request correction of your data.
  • Request deletion of data, object to processing, or restrict processing in cases provided by law.
